These Terms of Service ("Terms") govern your access to and use of the website yobitech.io and the cybersecurity services provided by Yobitech LLC ("Yobitech," "we," "our," or "us"). By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
1. Services Overview

- Penetration testing and vulnerability assessments
- Managed Security Service Provider (MSSP) solutions
- IT audit and security compliance consulting
- Security awareness training
- Incident response and remediation
- Virtual CISO (vCISO) services
Specific service engagements are governed by separate statements of work (SOW), service agreements, or order forms that supplement these Terms.
2. Use of Our Website
You agree to use our website only for lawful purposes and in accordance with these Terms. You may not:
- Use the website in any way that violates applicable laws or regulations
- Attempt to gain unauthorized access to any part of the website, servers, or systems
- Introduce viruses, malware, or other harmful code
- Scrape, crawl, or use automated tools to collect data without our written permission

3. Intellectual Property
All content on this website — including text, graphics, logos, images, software, and design — is the property of Yobitech LLC or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our prior written consent.
The Yobitech name, logo, and all related marks are trademarks of Yobitech LLC. Use of our trademarks without express written permission is prohibited.
4. Service Engagements
Professional cybersecurity services are provided under separate written agreements. These agreements may include:
- Scope of Work: A detailed description of services, deliverables, timelines, and responsibilities
- Authorization: Written authorization is required before any penetration testing, vulnerability scanning, or security assessment is conducted on your systems
- Confidentiality: Both parties agree to protect confidential and proprietary information exchanged during the engagement
- Fees and Payment: Service fees, payment schedules, and billing terms as specified in the applicable agreement
In the event of a conflict between these Terms and a service agreement, the service agreement shall govern with respect to the applicable services.
5. Confidentiality
Yobitech understands the sensitive nature of cybersecurity engagements. We maintain strict confidentiality protocols for all client data, assessment findings, and engagement details. Our team members are bound by non-disclosure agreements, and we follow industry best practices for handling sensitive information throughout the engagement lifecycle.
6. Limitation of Liability
To the fullest extent permitted by applicable law:
- Yobitech's total liability for any claims arising from our services shall not exceed the fees paid for the specific service giving rise to the claim
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- We are not liable for damages resulting from unauthorized modifications to systems after our engagement, or from failure to implement our recommendations
Our services are designed to identify and report on security vulnerabilities, but no security assessment can guarantee the discovery of all vulnerabilities or eliminate all risk.
7. Disclaimer of Warranties
Our website and its content are provided "as is" without warranties of any kind, whether express or implied. While we strive to keep information accurate and up to date, we do not warrant that the website will be uninterrupted, error-free, or free from harmful components. Cybersecurity information published on our blog or website is for educational purposes and does not constitute professional advice for your specific environment.
8. Indemnification
You agree to indemnify and hold harmless Yobitech LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of our website, violation of these Terms, or infringement of any third party's rights.
9. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of our website or services ("Dispute") shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules, rather than in court. The arbitration shall be conducted in Sarasota County, Florida, before a single arbitrator. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver
You and Yobitech agree that any Dispute shall be brought solely in your or our individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
Exceptions
Notwithstanding the above, either party may bring an individual action in small claims court for claims within its jurisdictional limits. Either party may also seek injunctive or equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
30-Day Opt-Out
You may opt out of this arbitration and class action waiver provision by sending written notice to legal@yobitech.io within 30 days of first accessing or using our website. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of this arbitration agreement.

Yobitech respects the intellectual property rights of others and expects users of our website to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we will respond to valid notices of alleged copyright infringement.
